약 한달이 좀 넘는 방학 기간을 마치고 시작된 첫 수업이라 새로운 설레임으로 임하였던 수업입니다.
교수님의 수업 시작 전 Caveat Message 가 가장 케이스를 통한 법 공부 전반을 아우르는 말씀이어서 기억에 남습니다.
Big picture 를 파악하는 연습을 하도록 하자;
방대한 케이스 내용 (특히 연방 헌법과 같이 historic background and factual situation 이 복잡하고 어려운 경우)을 익히는 경우 지엽적인 사항에 매몰되기 쉬운데, 항상 "why does this case matter so much?' and 'what is the core legal dispute at issue' 등과 같은 핵심 frame 을 잡는 연습을 하는 것이 중요하다는 말씀이었습니다.
Unexpected question 을 통한 배움을 즐기자;
라이브 수업을 통해 연구생들이 수업 전 준비를 통해 (혼자 하는 공부를 통해) 미처 생각하지 못한 질문을 받게 되는데,
이 부분이 바로 라이브 수업의 장점이며, 예상하지 못한 순간에도 순발력을 발휘하는 연습을 하게 되고 이것이 누적되면 로스쿨및 실무에서 필요한 소양을 쌓을 수 있게 된다.
오늘 케이스는 Marbury v. Madison 판례이고, U.S. Supreme Court 의 Judicial Review power 를 확인한 판례로 유명한 판결이었습니다.
Unexpected question #1.
what if Marbury did not have a cause to file a suit?.... if court didn't find a cause to file a suit, then the case should've dismissed with no ground.
what is the difference between 'the cause in this hypo' and the 'cause' mentioned in the opinion p154; No cause has been shown, and the present motion is for a mandamus....
cause to file a suit; means the legal dispute requried a legal remedy by the party in dispute, however, the 'cause' from the opinion means that there is no reason for Madison to refuse to deliver the commission to Marbury....
And from this, Marbury ask to issue a writ of mandamus to deliver the commision he should've received but failed to have.
Unexpected question #2.
Why the court tried to address whether Marbury has a legitimate qualification to seek a legal remedy in this case?
Does the court can order a mandamus to the executive branch?
What is the legal ground to address this issue from the 'checks and balance' perspectives.
If Marbury has a legal right to get a remedy, then what Madison should do is delivering the commission; it is not an enforcing a judicial branch to executive branch rather just ensuring a procedural practice of the executive branch.
Q3. Court opinion have to be based upon the legal ground not a political ground, and respecting the legislative branch's act.
Ordering a writ of mandamus is not originated from an 'original' jurisdiction but a 'appellate' jurisdiction, based upon the U.S. Constitution Articel III Section 2.
But the Judicial Act of 1789 Section 13 enacted by the 1st U.S. Congress; says this is an original jurisdiction, and this is unconstitutional; therefore. Section 13 of the Judiciary Act of 1789 is null and void.
With this opinion, Chief Justice Marshall successfully compromised the case originated from the political dilemma, and established precedent of 'judicial review'.

SCOTUS Appellate jurisdiction 과 이에 대한 Congress 의 입법을 통한 견제의 근거가 되는 U.S. Constitution Articel III Section2 의 Exceptions and Regulation clause; the Supreme Court possesses appellate jurisdiction "both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make." 에 대한 판결로,
Post-civil war (postbellum) Reconstruction Act 1867 에 따른 인신 보호 영장의 청구에 대한 대법원의 Appellate jurisdiction 권한을 무효화 하기위한 목적으로 의회가1868년 법 개정을 하였고, 1867년 Act 에 따른 Appeal 만 무효화 하도록 한 조항에 근거하여 Chief Justice Chase 는 Standing 없음을 근거로하여 case 를 기각하는 결정을 하였습니다.
