5. MCKENNA v. ORTHO PHARMACEUTICAL CORP 622 F.2d 657 (3d Cir. 1980)
Facts
Mckenna, Plaintiff, brought a suit for negligence, misrepresentation, and products liability against Ohio Pharmaceutical Corporation (Ortho), defendant. P claimed that her injuries such as cerebrovascular stroke, headaches, and transient ischemia attack were by caused by her injection of Ortho-Novum because P relied on D’s false assurance about the product’s safety. P commenced this suit in Pennsylvania state court, but on Ortho’s motion, the suit was removed to the federal district court in Pennsylvania court. But, the district court held that the cause of action was barred because the Ohio statute began to run, in 1969, and P brought this suit in 1973. The district court denied D’s motion for summary judgment because there is genuine issue of material fact existed when the statute limitation started.
Issue
The issue is whether the statute of limitations should be tolled until such time as P discovered, or by the exercise of reasonable diligence should have discovered the negligence act, even though his cause of action accrued at the termination of the patient-physician relation, or should start at the termination of the treatment.
Rule
Until such time as he discovered, or by the exercise of reasonable diligence should have discovered the negligence act, even though his cause of action accrued at the termination of the patient-physician relation. (Melnyk v. Cleveland Clinic)
Application
In this case, the statute of limitations should be tolled until P discovered because applying the treatment. In this case, P found the negligence in Ohio, but commenced in a Pennsylvania state court, but on D’s motion, removed to Pennsylvania federal district court. According to the borrowing statute of Pennsylvania, this court decided to apply Ohio law because the borrowing statute mandates the application of the law of the state where a cause of action arose. There were two precedent cases related to the statute limitations, but this court decided to apply ‘a discovery rule in Melnyk v. Cleveland Clinic.’ Because the ‘termination of concept in Wyler v. Tripi, which held that a cause of action came into existence at the time the physician-patient relationship terminated,’affords little relief in cases where the injury requires a long developmental period. Accordingly, this court decided to apply a discovery rule considering conditions, such as analogous cases, to predict how the state’s highest court would decide, but may not be bound by an intermediate state appellate court ruling. A federal court sitting in diversity should not mechanically follow precedent and blindly apply principles of stare decisis.
For the foregoing reasons, a discovery rule was adopted.
Conclusion
Reverse and remand.

이 케이스에서는, 소멸시효가 언제 시작하는 지에 대한 명확한 규정이 statute에 없어서 문제가 되었다. 이 문제는 substantive 문제이고, 따라서 주의 실체법을 따라야 한다.
연방법은 세 개의 법 중에 Melynk 케이스의 discovery rule 을 택한 이유는, 기계적으로 선례를 따르지 않고, 최신 condition과 향후 오하이오 주 법원이 어떻게 판결할지를 오하이오 주 법원 입장에서 예측하여 결정한 것이다.

펜실베니아 주 법원에 소를 제기한 경우에는, Personal Jurisdiction을 만족해야 하기 때문에 minimum contact가 있는지 확인해야 했고, 피고가 미국 50개 주에서 피츠버그 연방법원을 고른 이유에 대해 논의가 이루어졌다. 이 부분은 읽으면서 깊게 생각하지 않았던 부분이었는데, 어렵고도 중요한 문제라는 것을 알게 되었다.
재판의 본격적인 진행에 들어가기 전에, jurisdiction, statute of limitations, causation 등을 먼저 입증해야 본론에 들어갈 수 있다.
또한, Wyler와 Melnyk 케이스 중에서 하나를 선택할 경우에는, 판사 마음대로 선택하는 것이 아니라 authority 가 있어야 한다.
