4. Escola v. Coca Cola Bottling Co.
Facts
Plaintiff (P), a waitress brought a suit against Coca Cola (D) for negligence. When P moved coca cola bottles to the refrigerator, one of the bottles exploded in her hand, which caused serious injuries on her hand.
Issue
The issue is whether the doctrine of res ipsa loquitur can be applied to a case where it is impossible to show any specific acts of negligence, given that a defendant had exclusive control of the bottle and the plaintiff did not contribute to the accident.
Rules
[1] Res ipsa loquitur does not apply unless (1) defendant had exclusive control of the thing causing the injury and (2) the accident is of such a nature that it ordinarily [24 Cal.2d 458] would not occur in the absence of negligence by the defendant. Application
Yes, doctrine for applying the doctrine of res ipsa loquitur are met. First, the bottle was defective at the time D relinquished control and P did not contribute to the accident. It is a common understanding that bottles bottles of carbonated liquid are not defective without negligence by the bottling company. Even though the accident did not occur under D’s control, the alleged negligent act during D’s control did not alter the condition of the bottle afterward.
Moreover, P handled the bottle carefully.
If the bottle was excessively charged, an inference of D’s negligence would arise or if the explosion resulted from a defective bottle containing a safe pressure, the D would be liable because of failing to discover such a defect. If the defect were visible, D would be also liable because of failing to discover such a defect. Although it is not clear in this case whether the explosion was caused by an excessive charge or a defect in the glass, sufficient evidence showed that due care would have prevented the explosion.
Conclusion
Therefore, all the requirements are satisfied for the doctrine of res ipsa loquitur.

- 코카콜라 병이 폭발해서 다친 것은 causation이 아니라, 결과
- 의무를 위반해서 코카콜라 병이 터져야 함
- 입증은 원고가 해야 하지만, 깨진 병으로 이 제품 만든 근로자의 과실을 입증하는 것은 어려움
- 제조물을 과실로 입증할 수 없음
- Strict liability 로 해야, 피해자가 입증을 할 수 있음 - negligence 로는 입증 못하기 때문
(대량생산 제품은 입증 못함, 수작업으로 한 것은 입증 가능)
- 따라서 ,이 사건은, 코카콜라 병의 결함을 negligence 로는 안되고, strict liability로 하면 되는데, 이 때는product liability의 strict liability 이론이 생기지 않았을 때라서, 피해자에게 도움이 되는 이론을 판사가 적용한 것

- 제품의 하자로 인해 소를 제기하는 경우, battery는 intentional이니 거의 제외함 (battery인 경우는, 거의 없지만, 발생하는 예는, 테러, 독극물 주입 - 몸에 독이 들어감 - contact)
- negligence는 제조물 책임 입증하는 데는 잘안쓰이지만, 수작업으로 만든 제품인 경우에는 제조과정에 대한 과실입증이 가능하기 때문에, 가능. 하지만, 대량생산에는 입증을 못하기 때문에 소비자를 보호하지 위한 목적으로 strict liability 적용
- 이런 경우, defect 입증해야 함
- 사람의 과실유무와 상관없이 제품 자체의 defect 만 입증
